TERMS & CONDITIONS

Applicable to ALL Events

By payment of the booking and participation at any of the events organised by Country Ways Sportings and the Provider, the client and his/her guests are presumed to have read, understood and agreed to all the following terms and conditions. 

Defined Terms
    a. "Client" means the person booking and paying for the event and/or hospitality
    b. "Contractor" means Country Ways Sportings.
    c. "Provider" means the proprietor or their staff providing either the venue or the services necessary for the event and/or hospitality.

1. These terms and conditions apply to the provision of events and hospitality by the Country Ways Sportings ("the Contractor") through the Provider for the befit of the person signing this document ("the Client"). The following terms and conditions may not be amended or varied without the written consent of the Contractor. Return of these terms and conditions signed by the Client shall be deemed as acceptance of these terms and conditions.

2. Country Ways Sportings provides Scottish country pursuits and hospitality. We provide events and venues offered by third parties and deal with the arrangements and bookings for you. The responsibility for managing the activities on the day will rest with the Provider and his/her staff, whose advice and directions must be adhered to by the Client and his/her guests at all times. The activities will be conducted by the Client and his/her guests in a safe and responsible manner.

3. The information provided by Country Ways Sportings on each activity is correct at the time of booking. However, the content or format of experiences may change slightly during the year and depending on the Clients particular individual or group requirements.

4. Some venues may have their own terms and conditions and Client or guest participation is conditional on acceptance of these. Where applicable, these terms and conditions will be provided at the venue on the day of the event.

5. In some circumstances, Clients may be required to sign a disclaimer prior to commencing an activity e.g. quad biking. Where applicable this will be supplied by the Provider on the day of the event.

6. Certain experiences are subject to minimum or maximum requirements, e.g. age, health or weight. We will confirm with you at the time of booking if any restrictions apply to the participant. For clients own well being any adverse health condition should also be declared prior to the event.

7. Activities are supplied by or through a Provider upon their terms and conditions. The Contractor and Provider accept no liability for loss or damage arising from the activities selected by the client and his/her guests at the venue. Unless the Contractor specifically has agreed to undertake any part of those services the Contractor does not accept any responsibility for the proper performance or acceptability of those services by a Provider. The Contractor cannot warrant the Providers services nor the descriptions, representations or promises given by the Providers.

Payments, Deposits and Refunds

8. Should there be any change to the price prior to the event, the Client will be notified within 28 days of the booking.

9. A deposit and balance will be required by specified dates to secure your booking as stated in your booking/confirmation letter. Please make these payable by visa or cheque to "Country Ways Sportings", and send to Country Ways Sportings, 391 Union Street, Aberdeen, Scotland, AB11 6BX, by the date stipulated on the booking letter.

10. Country Ways Sportings has the right to cancel the event if payments are not received by the due dates.

11. In some circumstances, a balance may be due by the Client following the event e.g. where additional activities have been purchased by the Client on the day. An invoice for any outstanding amount will be sent to the Client via post/email and must be paid within 14 days of receipt.

12. Should a balance or refund be due from Country Ways Sportings to the Client payment will be made within the following calendar month of the invoice being sent. 

13. Additional guests are welcome but prior warning would be appreciated particularly with regard to accommodation.

14. Clients can extend their options on the day of the event, but subject to availability, and will be invoiced subsequently.

15. Should the event be cancelled on or before the date by Country Ways Sportings or the Provider due to unforeseen circumstances e.g. where specific elements of the experience such as vehicles or tutors/instructors are not available due to mechanical breakdown or illness, we reserve the right to make reasonable substitutions. If this is not possible we reserve the right to cancel the experience. Under such circumstances, any payments received from Clients will be refunded.

16. Many Country Ways Sportings experiences are dependent on the weather. If the weather becomes unsuitable for a particular activity we will contact you before setting out. If your experience is cancelled due to the weather you will be able to re-book, but your re-booked experience remains subject to weather conditions. Alternatively, we will refund your booking deposit if a suitable date cannot be agreed. Country Ways Sportings cannot be responsible for any other bookings made in relation to the event e.g. travel, flights, and accommodation.

17. Should a Client cancel a booking, a refund on the booking deposit will be subject to the cancellation terms and conditions of the Provider. Any cancellations must be send as written/email confirmation to Country Ways Sportings.

18. Refunds on the remaining booking fee are none refundable.

19. Country Ways Sportings complies with the Data Protection Act 1998 and its eight principles which require that data is: -

a. Processed for limited purposes
b. Adequate, accurate, relevant and not excessive
c. Not kept longer than necessary
d. Processed in accordance with the data subject's rights
e. Secure
f. Not transferred outside the EU without adequate protection

20. Country Ways Sportings will treat any data received from you with the strictest confidence but may use Client anonymous data for marketing or research purposes.
